Terms of Service ā€” TRUST DICOM Gateway

These Terms govern your use of TRUST DICOM Gateway (the ā€œSoftwareā€). Paid plans are sold through Polar. By installing the Software, activating a license, or completing Polar checkout, you agree to these Terms and Polarā€™s Checkout Buyer Terms.

1. Device-bound license

We grant you a non-exclusive, non-transferable license to install and run the Software on one workstation per valid Polar key. The license is bound to that device.

You may not share, resell, rent, sublicense, publicly post, or otherwise transfer a paid key. You may not circumvent license checks, clone an activated machine for extra unpaid seats, or offer the Software as a hosted service to third parties.

2. No resale

The Software, license keys, and documentation are not for resale. Distributors need a separate written agreement. Unauthorized resale or key pooling is a material breach and may result in immediate revocation without refund beyond what the Refund Policy already allows.

3. Subscription (Polar)

Monthly is $9.99/month. Yearly is $99/year (about two months free versus monthly). Subscriptions renew until you cancel in Polarā€™s portal. Expired or unpaid licenses stop converting and sending until renewed.

4. Acceptable use

You are responsible for DICOM configuration, patient consent, and messages you send via WhatsApp or Telegram. Do not use the Software to access systems you are not authorized to use, or in violation of law or clinic policy. The Software is a workflow tool; it is not a substitute for a certified diagnostic workstation or a medical device approval you may need in your jurisdiction.

5. Disclaimer and liability

THE SOFTWARE IS PROVIDED ā€œAS ISā€ AND ā€œAS AVAILABLEā€, WITHOUT WARRANTIES OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, OR BUSINESS. OUR TOTAL LIABILITY FOR A PAID PLAN SHALL NOT EXCEED THE AMOUNTS YOU PAID TO POLAR FOR THAT PLAN IN THE THREE (3) MONTHS BEFORE THE CLAIM.

6. Termination

You may stop using the Software and cancel Polar billing at any time. We may disable a license that is fraudulent, shared beyond its device limit, resold, or obtained in breach of these Terms.
